Refund Policy — SparLink

This Refund Policy is an integral part of SparLink's Terms and Conditions. In case of conflict between the two documents, the Terms prevail.


1. Summary

2. 14-day right of withdrawal (EU consumers)

If you are a consumer (a natural person acting outside their professional activity) residing in the EU, you have the right to withdraw from the SparLink subscription contract within 14 days of signing up, under Art. 52 et seq. of the Italian Consumer Code (Legislative Decree 206/2005) and Directive 2011/83/EU.

2.1 How to exercise withdrawal

Send an email to {{BILLING_EMAIL}} within 14 days of subscription activation, stating:

  1. The email associated with your SparLink account;
  2. The plan you subscribed to (Practitioner, Coach, Gym);
  3. A statement of your intent to withdraw from the contract.

You can use the model withdrawal form in § 6.

2.2 Refund timing

The refund will be issued within 14 days of receipt of the request, to the same payment method used. The actual credit to your account/card depends on the banking network (usually 3–10 additional business days).


3. Exception — digital service already started

Under Art. 59, letter o) of the Italian Consumer Code, the right of withdrawal lapses (or is limited) when:

  1. The consumer has expressly consented to immediate performance of the digital service; AND
  2. The consumer has acknowledged losing the right of withdrawal once performance begins; AND
  3. The Provider has confirmed the agreement on a durable medium (e.g., email).

When subscribing to a paid plan, SparLink collects this explicit consent (mandatory checkbox). As a result:

3.1 Scenario A — trial not used, no payment taken

During the 14-day trial no charge is made. If you cancel before the end of the trial, you have not been charged and do not need to request a refund.

3.2 Scenario B — subscription activated, premium features NOT used

If you activated a paid subscription (post-trial or direct) but have not used any premium features, you are entitled to a full refund within 14 days.

3.3 Scenario C — subscription activated, premium features used

If you used premium features (e.g., advanced matchmaker, coach dashboard, travel mode), the refund may be reduced proportionally to the service already used, or fully lapsed if you expressly waived the right of withdrawal at activation.

The Provider reserves the right to assess each request fairly and in accordance with the Italian Consumer Code.


4. Cancellation after 14 days

After 14 days from subscribing, you can cancel your subscription at any time from the account settings.

  • Effect of cancellation: the subscription will not renew at the next period.
  • Access to premium features: you will continue to use them until the end of the already-paid period.
  • No pro-rata refund — in line with Stripe's policy and market practice, the current period's fee is not refunded.

Example: I pay for Practitioner monthly on the 10th of the month, I cancel on the 25th — I keep access until the 9th of the following month, then I return to the Free plan with no further charges.


5. Special cases

5.1 Prolonged Service malfunction

If the Service has been unusable for more than 72 consecutive hours due to causes attributable to the Provider (excluding scheduled maintenance, force majeure, external causes such as Stripe/Railway/Vercel outages), you can request a pro-rata refund for the days of disruption.

Write to {{BILLING_EMAIL}} stating the dates of disruption you experienced. We will verify against our logs and respond within 30 days.

5.2 Double charge or technical error

If you notice an unintended or duplicate charge, write to us immediately at {{BILLING_EMAIL}}. If confirmed, the refund is full and immediate.

5.3 Ban for Terms violation

In case of account closure for a serious violation of the Terms of Service (see ToS § 3), no refund is provided for the unused subscription period. This policy reflects the sanctioning nature of the closure and the user's responsibility for the conduct in question.

5.4 Chargeback

If you initiate a chargeback (dispute with your bank/card) without first contacting us, your account may be suspended pending resolution. We invite you to write to {{BILLING_EMAIL}} first to resolve the matter amicably.

5.5 Service discontinuation by the Provider

In case of Service discontinuation (ToS § 11), the Provider will refund pro-rata the unused portion of the subscription.


6. Model withdrawal form

You can use the following form (optional) to exercise the right of withdrawal within 14 days. Copy and paste it into an email to {{BILLING_EMAIL}}, fill in the parts in square brackets, and send.

7. Refund operational process

  1. You send a request by email to {{BILLING_EMAIL}}.
  2. Receipt confirmation within 2 business days.
  3. Verification within 10 business days (we verify the account, feature usage, and compliance with this policy).
  4. Outcome — response by email with a reasoned decision.
  5. Refund (if granted) — credited within 14 days of the decision to the same payment method (usually Stripe → original card in 3–10 business days).

Indicative total timeline: up to 30 days from request to the refund actually appearing on your account.

9. Complaints and out-of-court resolution

If you are not satisfied with the outcome of a refund request, you can:

  • Write to legal@sparlink.app for a review.
  • Use the European Commission's online dispute resolution (ODR) platform: https://ec.europa.eu/consumers/odr/
  • Contact the European Consumer Centres (ECC-Net).
  • Take action in the competent court (see Terms § 13).
